PROCESS OF BUYING A HOUSE IN SPAIN
Before purchasing a property or even signing a private contract, it is advisable to contact a lawyer to verify that all the documents are in order. It is important to give him a power of attorney so that he can represent you before the Tax Office and sign the deeds on your behalf.
The lawyer has a legal obligation to act on your behalf, which means that he must work in your favor and represent you throughout the purchase process.
If it is a house already built, a private contract is first signed to bind both parties and set a date to sign the deeds.
This document will establish the payments to be made and the completion date by both the seller and the buyer. For this procedure it is advisable to open a bank account in Spain.
Your lawyer can open the account in your name, but banks may require the holder to be in Spain three months before to meet with them personally.
Generally, the last payment is completed at the same time as the deeds are signed, as long as all the property documents are in order.
After signing the deeds, your lawyer will proceed to register the property in the Property Registry.
